Humboldt County CalCannabis Appellations Project Public Workshop

The California Department of Food and Agriculture will be holding a CalCannabis Appellations Project Public Workshop in Humboldt County on Wednesday, September 12th from 4:00 pm to 7:00 pm at the Sequoia Conference Center, Room B located at 901 Myrtle Avenue in Eureka.

The CDFA is looking for feedback from the cannabis community to help establish a framework for the CalCannabis Appellations Project. You can attend the workshop and share your suggestions. Your feedback will help to establish appellations of practices, standards and varieties applicable in a specific geographic region in California.

Joe Knows Cannabis ConsultingWho is Joe and what does he know? Joe Moran, General Manager of 1 Degree Consulting a division of Humboldt Green®, is part of the Humboldt County cannabis brain trust. Growing cannabis has been Joe’s passion for almost three decades and he cultivated under Prop 215 for many years. He graduated from Humboldt State University in 1997 with a Bachelor of Science in Natural Resource Planning. Joe’s education in rural environment land use was instrumental in his efforts to organize large-scale music and cannabis events and festivals since the early 1990’s. Joe has been an integral part of planning and permitting for events such as Reggae on the River, Reggae Rising, HempFest West, Humboldt Garden Expo, Cannifest, the Yes We Cann Parade & Hullabaloo and many other local cannabis events.

Living in Humboldt, studying environmental planning as well as being part of the cannabis culture and industry has led Joe to a unique position as a cannabis consultant. As part of the cannabis community for almost thirty years, Joe has a solid understanding of the historical pathway to legalization in California. He has combined his education, experience and passions to help build bridges to compliancy for the cannabis community.

The Humboldt Cannabis Council, Humboldt’s braintrust for a new cannabis future holds a regular podcast inviting members of the industry to weigh in on hot topics in our community as we ride the wave of cannabis legalization in California.

In the first episode, “The State of the Humboldt Union” the group discusses the current state of cannabis in Humboldt, where compliant cannabis businesses need to be in the near future and some ideas about what is going to happen as California cannabis industry matures.

Licensing Authorities Announce Withdrawal of Proposed Medical Cannabis Regulations

SACRAMENTO – California’s three cannabis licensing authorities announced today the official withdrawal of the medical cannabis regulations that were proposed in late spring by the Department of Consumer Affairs’ Bureau of Cannabis Control, Department of Public Health’s Manufactured Cannabis Safety Branch and Department of Food and Agriculture’s CalCannabis Cultivation Licensing. The official withdrawal will occur October 6. The proposed regulations were geared toward the implementation of the Medical Cannabis Regulation and Safety Act. These licensing authorities held hearings and accepted public comments regarding the proposed regulations during a 45-day public comment period.

However, in late June, the Legislature passed and the Governor signed into law, the Medicinal and Adult-Use Cannabis Regulation and Safety Act, which creates one regulatory system for both medicinal and adult-use cannabis. Because of that action, the licensing authorities will withdraw the proposed medical regulations and will instead move forward with one regulatory package for both medicinal and adult-use cannabis.

The three cannabis licensing authorities will develop emergency regulations based on the new law and will incorporate the robust and valuable public comment received on the proposed medical cannabis regulations. The licensing authorities will use the emergency rule-making process for the new regulations. The emergency regulations are expected to be published in November. The implementation date for the issuance of commercial cannabis licenses remains the same: January 1, 2018.

2018 California Cannabis Tax Information

The Bureau of Cannabis Control released the following information about California Cannabis Taxes scheduled to begin January 1, 2018.

“If you sell cannabis or cannabis products, you must register with the California Department of Tax and Fee Administration (CDTFA) for a seller’s permit. Cannabis cultivators, processors, manufacturers, retailers, microbusinesses, and distributors making sales are required to obtain and maintain a seller’s permit as a prerequisite for applying for a license with the California Department of Food and Agriculture, the California Department of Consumer Affairs, or the California Department of Public Health.

Distributors of cannabis and cannabis products must also register with the CDTFA for a cannabis tax permit to report and pay the two new cannabis taxes to the CDTFA. The cannabis tax permit is in addition to your seller’s permit.

Beginning January 1, 2018, two new cannabis taxes are in effect:
• A 15 percent excise tax is imposed upon purchasers of cannabis and cannabis products. Retailers are required to collect the excise tax from the purchaser and pay it to the cannabis distributor.
• A tax on the cultivation of cannabis that enters the commercial market is imposed upon cultivators. Cultivators are required to pay the cultivation tax to either a distributor or a manufacturer depending upon the nature of the transaction.

The cultivation tax rates are:

  •  $9.25 per dry-weight ounce of cannabis flowers
  •  $2.75 per dry-weight ounce of cannabis leaves

All cannabis businesses making sales are required to:
• Register online with the CDTFA for a seller’s permit.
• File sales and use tax returns electronically and pay any sales and use tax to the CDTFA. Even if none of your sales are subject to sales tax, you are still required to file a return and report your activities on your return to the CDTFA.

In addition, if you are a cannabis distributor, the following requirements apply to you:
• Prior to January 1, 2018, register online with the CDTFA for a cannabis tax permit. (Registration will be available in November 2017.)
• Beginning January 1, 2018, collect the excise tax from retailers you supply.
• Beginning January 1, 2018, collect the cultivation tax from cultivators or manufacturers that send or transfer cannabis and cannabis products to you.
• File both your cannabis tax and sales and use tax returns electronically and pay any tax amounts due to the CDTFA.”

Yes We Cann Parade Details

The Yes We Cann Parade and Hullabaloo is almost here! We are marching through Arcata on Saturday, August 12th. The parade will start at 2:00 PM in the HSU Parking Lot at the corner of 14th and Union streets and end at the Arcata Ball Park at 3:00 pm.

Yes We Cann Parade route through the streets of Arcata.

Check-in and parade line up will be held between 11:00 AM and 1:30 PM. Please arrive during the designated check-in time so that we can get you lined up and ready to go. We encourage you to signup for the parade online prior to August 12th, but in-person registrations are welcome the day of the parade.

During check-in, everyone in your group will need to sign a waiver in order to walk in the parade. After you sign the waiver you will receive a wristband that will be used as your free entry into the Hullabaloo event at the Ball park. Once check-in is complete we will direct you to the parade Staging Coordinator who will line you up in the appropriate area. You MUST have your wristband to walk into the parade. Legally, we cannot have folks who have not registered jumping into parade from the sidelines.

There will be hydration stations along the parade route, however we encourage you to bring a water bottle and stay hydrated. Make sure to protect your skin and wear sunscreen or bring a hat. Keep in mind that you will be walking a good distance so wear comfortable shoes and clothing.

Please make sure to clean up after yourself and leave no trash behind at the starting point of the parade in the HSU parking lot. It is our goal to leave the space better than when we found it.

When the parade ends at the Arcata Ball Park for the Hullabaloo, you must disperse and clear the streets so that we don’t hold up regular traffic. If you plan to attend the Hullabaloo, please plan ahead and figure out a game plan for where to park your float.

The Cannabis Queens have been lining up to be in the Yes We Cann Parade on August 12th in Arcata. They have stepped forward to honor the sacred and feminine. To create balance, we’re looking for a few good Kings to help expand the royal cannabis court.

Are you a Cannabis King interested in escorting the Queens and Cannifest float through the streets of Arcata? Register early and sign up to be a King in the Yes We Cann Parade. Make sure to mark the cannabis queens and kings check box on the registration form so that we know to add you to the royal cannabis court.

You could even make your own Kings float and get all of your buddies to ride on it with you.

The Yes We Cann Parade is a celebration of our industry’s coming of age and a shift in our culture stepping out of the shade and into the light. We welcome you to be a part of this new tradition and show your support for creating a sustainable, inclusive and positive cannabis community. Together we can say yes to change and parade peacefully together to lift up our community and show the world we are one.

Parade participation is open to everyone. Farmers, cannabiz, organizations, non-profits, local businesses, schools and groups in support of the cannabis community are all invited to participate in the parade and Hullabaloo.

Save the date for Saturday, August 12th! Check-in and parade line up is from 11:00 am to 1:30 pm. The parade kicks off at the HSU parking lot located at 14th & Union street at 2:00 pm and ends at the Arcata Ballpark. The party continues with the Hullabaloo at the ballpark until 10:00 pm.
